ATLANTA — A Gwinnett family-owned car wash is facing up to a $110 million lawsuit because it sent out faxes advertising its services.
The more than two-year-old dispute is linked to the 1991 Telephone Consumer Protection Act — a law business owner Bruce Arnett never even heard of when he was accused of breaking it in 2002.

“It’s a land mine waiting for businesses who have no idea the law is even out there,” said Arnett, who runs Lilburn-based Carnett’s Inc. car washes. Launched in Gwinnett 17 years ago, the company has 15 metro-Atlanta car washes.

The legal mess for Carnett’s began a few years ago after the business hired Texas-based Sunbelt Communications to fax coupons to people in the market the company serves. Arnett said Sunbelt Communications assured him faxing the coupons would not get him in legal hot water.

Gwinnett resident Michelle Hammond was among the 73,500 people who received one of the coupons on her fax machine.
Hammond later sued the car wash business under the Telephone Consumer Protection Act, a law that bars junk faxes and allows individuals to collect damages of $500 to $1,500 from violators.
A Gwinnett trial court refused to grant her lawsuit class-action status. Had the suit been granted class-action status, the penalties facing Carnett’s would have increased to at least $36 million and at most $110 million.

Former Gov. Roy Barnes joined the fray last year and helped Hammond win the legal battle at the state Court of Appeals, which reversed the lower court’s denial of class action. “Michelle Hammond is a young business woman who was getting these faxes from everyone all the time,” Barnes said last week. “These junk faxes interrupt the flow of business and cost the business owners time and money. It’s our fax machines that are being jammed, and our fax paper that’s being used.”

Hammond first wrote a letter to Carnett’s saying she was not a customer, objected to the fax and wanted the car wash business to pay the $500 fine for violating the Telephone Consumer Protection Act, Barnes said. When Carnett’s refused to settle up, Hammond sued, Barnes said.

Now, the question of whether the lawsuit can proceed as a class-action case will be decided by the state Supreme Court. To give the class action the go-ahead, the court must first decide if it will hear the case. No date for a decision has been set. Millions of dollars in fees hinge on the court’s ruling.

“Without the class-action status, it all falls apart,” said Richard C. Foster, a Carnett’s attorney.
Arnett has an insurance policy through Georgia Casualty to protect his business against the giant fees and penalties a class-action lawsuit could carry. However, he said his legal battle is for other small companies that may be “blindsided” by a law he feels serves little purpose other than to fatten lawyers’ paychecks.

“It’s an attack on small businesses,” he said. “The punishment doesn’t fit the crime.”

In a recent brief filed with the Supreme Court, attorneys for Carnett’s say, “This is one of an increasing number of (Telephone Consumer Protection Act cases) filed in the Georgia trial courts against Georgia businesses seeking tens or hundreds of millions of dollars. These cases are not brought against the fax transmitter, but against local businesses who innocently purchased advertising services.”

Barnes said most business owners should be familiar with laws designed to combat junk e-mails and faxes, especially given the recent backlash against telemarketing.
